Service Terms and Conditions

1. Duration

This Agreement commences on the date of acceptance by DMV Telecom Ltd and will continue unless terminated by either party with at least one month’s prior written notice or as specified in Section 8.

2. Use of Service

2.1 DMV Telecom Ltd will provide the Service to the Customer subject to this Agreement and availability, ensuring high quality and reliability.

2.2 All information related to the Customer collected by DMV Telecom Ltd will remain confidential and used solely for purposes permitted under this Agreement, the Act, or other relevant regulations.

2.3 The Customer agrees to use the Service in accordance with these conditions and any written variations notified by DMV Telecom Ltd, complying with the Act and other relevant regulations.

2.4 The Customer indemnifies DMV Telecom Ltd against all liabilities, claims, losses, damages, or expenses arising from the Customer’s use of the Service or DMV Telecom Ltd’s provision of the Service.

2.5 The Customer must not use the Service for any illegal, unlawful, or offensive purposes.

2.6 The Customer must immediately notify DMV Telecom Ltd of any Service failures or malfunctions.

2.7 DMV Telecom Ltd will aim to correct any Service issues within two working days or as soon as reasonably practicable.

2.8 The Service is provided for business use only and is not guaranteed to be continuous. There may be periods of unavailability for operational or other reasons.

2.9 The Customer may change the call forwarding destination by contacting DMV Telecom Ltd.

2.10 The Service cannot be used to generate artificially inflated traffic (AIT) or for call through/dial through purposes. Detected AIT or fraudulent traffic will result in immediate service termination.

2.11 The Customer shall only forward calls to UK landlines and mobiles, excluding:

  • Follow me type numbers (070)
  • Isle of Man numbers
  • Guernsey/Jersey (Channel Island) numbers
  • Premium rate numbers
  • Numbers not belonging to the Customer or their staff

2.12 Fair Usage Policy: The Service is subject to a fair usage limit of 10,000 minutes per month. Excessive or repeated breaches of this fair usage limit may incur additional charges at a rate of 5p per minute for UK landlines and mobiles. Higher rates may apply for follow me type numbers, Channel Island numbers, Isle of Man numbers, or other overseas numbers. DMV Telecom Ltd reserves the right to close any account in the event of excessive or repeated breaches.

2.13 If call recording is enabled, it must comply with UK law, including informing callers that calls are being recorded.

3. Prices and Payment

3.1 The Customer shall pay a monthly fee of £10 for unlimited usage, subject to the Fair Usage Policy.

3.2 DMV Telecom Ltd will invoice the Customer monthly, and the account must remain in credit at all times.

3.3 Invoices are due within 14 days of the invoice date. Overdue invoices will incur a £5.00 late payment fee, applied to the next invoice.

3.4 Interest on overdue invoices will be charged at 4% above the Lloyds Bank base rate until paid.

3.5 Invoices are payable via card payments.

3.6 Failure to pay on time may result in service suspension or termination.

4. Liability & Compensation

4.1 If the Service is unavailable for more than 48 continuous hours, the Customer may request compensation. Compensation will be double the amount of rent paid for the period of unavailability, but not exceeding the rent paid by the Customer.

4.2 DMV Telecom Ltd shall have no liability for loss of goodwill, revenue, anticipated savings, profit, or any direct, indirect, or consequential financial loss.

5. Provision of Information

The Customer agrees to provide DMV Telecom Ltd with any information reasonably required to fulfill its obligations under this Agreement.

6. Porting Numbers

6.1 Numbers can be ported out upon request, subject to the Customer providing proof of identity, proof of address, and any other documentation reasonably required by DMV Telecom Ltd.

6.2 The same requirements apply for numbers being ported into DMV Telecom Ltd’s Service.

7. Suspension of Service

7.1 In the event of a breach of this Agreement by the Customer, DMV Telecom Ltd may suspend Service provision upon written notification.

7.2 Suspension of Service entitles DMV Telecom Ltd to demand payment of all amounts owed by the Customer.

7.3 Reconnection after suspension will incur a £30.00 fee per number.

8. Termination

8.1 Either party may terminate the Agreement if the other party defaults on its obligations and fails to rectify the default within a specified reasonable time.

8.2 DMV Telecom Ltd may terminate the Agreement if a liquidator, trustee in bankruptcy, receiver, or administrator is appointed over the Customer’s assets/business, or if the Customer is deemed insolvent.

8.3 DMV Telecom Ltd may terminate the Agreement if its licence under the Act is revoked.

9. Notices

9.1 Any notice, invoice, or document shall be deemed duly given if sent by email or post to the address or email address on the Customer’s account.

9.2 The Customer shall notify DMV Telecom Ltd of any change of address, telephone number, or email address.

10. Force Majeure

Neither party shall be in breach of its obligations for any loss or damage due to causes beyond their reasonable control, including but not limited to acts of God, inclement weather, failure of power supplies, strikes, trade disputes, acts or omissions of Government authorities, telecommunications providers, war, military operations, or riots.

11. Governing Law

This Agreement shall be governed by and construed in accordance with English Law, and the parties submit to the jurisdiction of the English Courts.

1. Intellectual Property

1.1 All content on the Landline Cloud website, including text, graphics, logos, images, and software, is the property of DMV Telecom Ltd or its content suppliers and is protected by intellectual property laws.

1.2 You may not copy, reproduce, distribute, or create derivative works from any content on the website without the express written consent of DMV Telecom Ltd.

2. Use of Website

2.1 You agree to use the website only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the website.

2.2 Unauthorized use of this website may give rise to a claim for damages and/or be a criminal offense.

3. Pricing and Availability

3.1 All prices and availability information are subject to change without notice.

3.2 DMV Telecom Ltd endeavors to ensure that all pricing information on the website is accurate, but errors may occasionally occur. In the event of a pricing error, DMV Telecom Ltd is not obliged to fulfill orders at the incorrect price.

4. External Links

The Landline Cloud website may contain links to external websites. DMV Telecom Ltd is not responsible for the content or availability of these external sites.

5. Limitation of Liability

DMV Telecom Ltd shall not be liable for any indirect or consequential loss or damage arising out of or in connection with the use of the website.

6. Changes to Terms & Conditions

DMV Telecom Ltd reserves the right to change these terms and conditions at any time. Any changes will be posted on this page.

7. Governing Law

These terms and conditions are governed by and construed in accordance with English Law, and any disputes will be decided only by the English Courts.
